I. General Definitions

• Terms and Conditions – these Terms and Conditions

• Service Provider – the owner of the Service, being a natural person – Paweł Kwiatkowski
• User – any natural person who accesses the Service and uses the services provided through the Service by the Service Provider.
• Electronic Communication – communication between the parties via electronic mail (e-mail) and contact forms available on the website.

II. General Provisions

• These Terms and Conditions define the rules for the operation and use of the Service and specify the scope of rights and obligations of Users and the Service Provider related to the use of the Service.
• The subject of the Service Provider’s services is the provision of free tools in the form of the Service, enabling Users to access content such as posts, articles, audiovisual materials, web applications, and electronic forms.
• Any content, articles, and information containing features of tips or advice published within the Service constitute only a general set of information and are not directed at specific Users. The Service Provider shall not be liable for their use by Users.

All risks associated with the use of the Service, and in particular with the use and application of information contained therein, are borne by the User using the Service.

• In order to ensure the security of the Service Provider, Users, and other Users of the Service, all Users using the Service should follow generally accepted online security rules,
• The following actions performed personally by Users or using software are prohibited:
  • without written consent, decompiling and analyzing source code,
  • without written consent, causing excessive load on the Service server,
  • without written consent, attempting to identify security vulnerabilities in the Service or server configuration,
  • attempting to upload or inject code, scripts, or software into the server or database that may cause damage to the Service software, other Users, or the Service Provider,
  • attempting to upload or inject code, scripts, or software into the server or database that may track or steal data of Users or the Service Provider,
  • undertaking any actions aimed at damaging, blocking the operation of the Service, or preventing the Service from achieving its intended purpose.
• In the event of detecting an actual or potential Cybersecurity incident or GDPR breach, Users should first report this fact to the Service Provider in order to promptly eliminate the issue or threat and protect the interests of all Users of the Service.

IV. Registration Terms and Rules

• Users may use the Service without registering.
• Users must be registered and have an account in the Service to use additional services provided within the Service, available only to logged-in Users.
• Registration in the Service is voluntary.
• Registration in the Service is free of charge.
• Each User may have only one account in the Service.
• Technical requirements related to account registration:
  • having an individual e-mail account,
• Users registering in the Service consent to the processing of their personal data by the Service Provider to the extent that such data were entered into the Service during the registration process and during subsequent modifications or deletion.
• The Service Provider has the right to suspend or delete User accounts at its sole discretion, thereby preventing or limiting access to some or all services, content, materials, and resources of the Service, in particular if the User violates these Terms and Conditions, generally applicable laws, principles of social coexistence, or acts to the detriment of the Service Provider or other Users, the legitimate interest of the Service Provider, or third parties cooperating or not cooperating with the Service Provider.
• All services of the Service may be modified in terms of their content and scope, added or removed, as well as temporarily suspended or restricted, at the sole discretion of the Service Provider, without the possibility for Users to raise objections in this regard.
• Additional security rules related to account use:
  • Registered Users are prohibited from sharing their login credentials and passwords with third parties.
  • The Service Provider has no right and will never request the User’s password for any account.
• Account deletion:
  • Each User with an account in the Service has the option to delete their account independently.
  • Users may do so after logging into their Service panel.
  • Deleting an account results in the removal of all identifying User data and anonymization of the username and e-mail address.

V. Newsletter Service Terms

• Users may use the Service without subscribing to the Newsletter.
• Subscription to the Newsletter service is voluntary.
• Subscription to the Newsletter service is free of charge.
• Technical requirements related to the Newsletter service:
  • having an individual e-mail account,
• Conditions for providing the Newsletter service:
  • providing an individual e-mail address in the electronic form,
  • verification of the provided e-mail address by activating the link sent to it,
  • consent to receive e-mail notifications,
• Scope of the Newsletter service:
  • notifications about new updates, posts, contests, and other promotional activities related to the Service,
  • notifications about promotional activities of Service partners (Marketing messages),
• Unsubscribing from the Newsletter service:
  • Each User subscribed to the Newsletter has the option to unsubscribe independently.
  • Users may do so via the link included in each e-mail message sent.
  • Unsubscribing from the Newsletter results in the removal of the provided e-mail address from the Service Provider’s database.

VI. Communication and Provision of Other Services within the Service

• The Service provides services and tools enabling Users to interact with the Service in the form of:

• In the event of User contact with the Service Provider, Users’ personal data will be processed in accordance with the "Privacy Policy", which constitutes an integral part of these Terms and Conditions.

VII. Collection of User Data

In order to properly provide services through the Service, protect the legal interests of the Service Provider, and ensure compliance with applicable law, the Service Provider collects and processes certain data about Users via the Service.

For proper service provision, the Service uses and stores certain anonymous information about Users in cookies.

The scope, purposes, methods, and principles of data processing are available in the appendices to these Terms and Conditions: "GDPR Information Obligation" and the "Privacy Policy", which constitute an integral part of these Terms and Conditions.

  In the case of logged-in Users (having an account in the Service), a User identifier associated with the User’s account may be stored in cookies on the User’s device.

• Data collected when subscribing to the newsletter:
  e-mail address

VIII. Copyright

• The Service Provider is the owner of the Service and holds the copyright to the Service.
• Some data published in the Service is protected by copyrights belonging to companies, institutions, and third parties not affiliated in any way with the Service Provider, and is used under obtained licenses or free licenses.
• Pursuant to the Act of February 4, 1994 on Copyright, it is prohibited to use, copy, reproduce in any form, or store in search systems—excluding Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook, and LinkedIn—any articles, descriptions, photos, or any other content, graphic materials, video, or audio contained in the Service without the written consent or consent granted via Electronic Communication by their legal owner.
• In accordance with the Act of February 4, 1994 on Copyright, simple press information—understood as information alone, without commentary or evaluation by its author—is not subject to protection. The author understands this as the possibility of using information from texts published in the Service, but not copying all or parts of articles unless explicitly indicated in the specific material made available in the Service.

IX. Amendments to the Terms and Conditions

• All provisions of these Terms and Conditions may be amended unilaterally by the Service Provider at any time without stating reasons.
• Information about amendments to the Terms and Conditions will be sent electronically to Users registered in the Service.
• In the event of amendments to the Terms and Conditions, their provisions shall take effect immediately upon publication for Users without accounts in the Service.
• In the event of amendments to the Terms and Conditions, their provisions shall take effect after a 7-day transition period for Users with accounts registered before the amendment.
• It is deemed that any User who continues to use the Service after amendments to the Terms and Conditions accepts them in full.

X. Final Provisions

• The Service Provider will make every effort to ensure that the Service operates continuously. However, it shall not be liable for disruptions caused by force majeure, unauthorized interference by Users or third parties, or the operation of external automated programs.

• The Service Provider reserves the right to temporarily, fully, or partially disable the Service for improvement, addition of services, or maintenance, without prior notice to Users.
• The Service Provider reserves the right to permanently disable the Service without prior notice to Users.
• The Service Provider reserves the right to assign, in whole or in part, any of its rights and obligations related to the Service, without the consent of and without allowing Users to raise objections.
